This article presents a discussion about using one’s body – in its several occurrences, forms and meanings – for sex, affection and money transactions, within and beyond the scope of prostitution. It results from research carried out with young women involved in prostitution in two Brazilian north-eastern towns. The women’s views, conceptualisations and experiences reveal a prolific construction of discursive differentiation categories, which are linked to a set of moralities within local/regional economies and within notions of family. Through the women’s (...) personal narratives and experiences, our study demystifies the persistent idea of victimisation; it aims at understanding the young women prostitutes in their own contexts – loci that are highly stigmatised and seen as needing to be controlled or ‘developed’. We collected data that allows us to build a counter-discourse to oppose the ever-present attempts at weakening these voices and effacing their meaning-making. Within this context of knowledge production, our research is meaningful and purposeful in addressing the situation of young women in contexts of prostitution. Our main argument is that in certain contexts, such as those studied in this project, sex, affection and kinship are structured as normative – rather than exceptional – ways for women to have access to money. Recent arguments claim that behavioral science has focused – to its detriment – on the individual over the system when construing behavioral interventions. In this commentary, we argue that tackling economic inequality using both framings in tandem is invaluable. By studying individuals who have overcome inequality, “positive deviants,” and the system limitations they navigate, we offer potentially greater policy solutions.

ObjectiveThis study aims to analyze sociohistorically how the normative patterns of hegemonic masculinity produced impacts on men’s health/mental health in the context of the COVID-19 pandemic.MethodsA qualitative study from a socio-historical perspective was conducted with 50 men based on an online survey. A semistructured form was applied. The data were analyzed by the Collective Subject Discourse method, interpreted in the light of the context of epidemic disease and hegemonic masculinity.ResultsThe experience of the pandemic exposed the normative patterns of masculinities from (...) the consummation of acts representative of the pandemic context, which incited men to deny the existence of COVID-19 disease and to delay the understanding and adoption of measures to protect and control COVID-19. As a repercussion, men presented conflicts in the regulation of emotions; presented emotional suppression; were more reactive; felt threatened regarding the loss of the role of family provider, virility; and revealed a sense of invulnerability, added to the weakening of self-care.ConclusionThe discourse revealed that the men’s behaviors are consistent with the characteristics of hegemonic masculinity, but express signs of recognition that this behavior causes harm to themselves and their health. Se, à primeira vista, os dois universos de discurso parecem tão distantes que dificilmente se vê o que os aproxima, parece haver contudo uma flama comum que os anima, na medida em que ambos buscam evitar o aprisionamento do espírito local (...) nos grilhões de um universo simbólico que não é o seu. O objetivo deste estudo é explorar cada uma das obras, em seus respectivos contextos, a fim de delinear os aspectos dessa chama comum que as motiva; após a confrontação dos dois textos, far-se-á, como conclusão, um breve esboço dos possíveis ganhos dessa abordagem comparativa.: This article is an exercise in the comparative reading of the Fichte’s Reden an die deutsche Nation, published in Berlin in 1808, and Robert Gomes’ Crítica da razão tupiniquim, published in São Paulo in 1977. At first glance, the two universes of discourse appear to be so distant as to render considerably difficult any kind of comparison. However, they seem to be animated by a common spirit inasmuch as both are essays that articulate an epistemological resistance to the imminent danger of being enclosed in a symbolic universe that bears no contact with their own socio-political realities. The aim of this study is to explore each text in its respective context, so as to delineate the main aspects of their commonality. An extended examination of Libet's works led to a comprehensive reinterpretation of his results. According to this reinterpretation, the Minimum Train Duration of electrical brain stimulation should be considered as the time needed to create a brain stimulus efficient for producing conscious sensation and not as a basis for inferring the latency for conscious sensation of peripheral origin. Latency for conscious sensation with brain stimulation may occurafterthe Minimum Train Duration. Backward masking with cortical stimuli suggests a 125-300 ms minimum value (...) for the latency for conscious sensation of threshold skin stimuli. Backward enhancement is not suitable for inferring this latency. For determining temporal relations between stimuli that correspond to subjects' reports, theendof cerebral Minimum Train Duration should be used as reference, rather than its onset. Results of coupling peripheral and cortical stimuli are explained by a latency after the cortical Minimum Train Duration, having roughly the same duration as the latency for supraliminal skin stimuli. Results of coupling peripheral stimuli and stimuli to medial lemniscus (LM) are explained by a shorter LM latency and/or a longer peripheral latency. This interpretation suggests a 230 ms minimum value for the latency for conscious sensation of somatosensory near-threshold stimuli. The backward referral hypothesis, as formulated by Libet, should not be retained. Long readiness potentials preceding spontaneous conscious or nonconscious movements suggest that both kinds of movement are nonconsciously initiated. The validity of Libet's measures of W and M moments (Libet et al., 1983a) is questionable due to problems involving latencies, training, and introspective distinction of W and M. Veto of intended actions may be initially nonconscious but dependent on conscious awareness. (shrink)

In this paper I distinguish two ways of raising a sceptical problem of others' minds: via a problem concerning the possibility of error or via a problem concerning sources of knowledge. I give some reason to think that the second problem raises a more interesting problem in accounting for our knowledge of others’ minds and consider proposed solutions to the problem.

In this paper I defend the claim that testimony can serve as a basic source of knowledge of other people’s mental lives against the objection that testimonial knowledge presupposes knowledge of other people’s mental lives and therefore can’t be used to explain it.

Scepticism is sometimes expressed about whether there is any interesting problem of other minds. In this paper I set out a version of the conceptual problem of other minds which turns on the way in which mental occurrences are presented to the subject and situate it in relation to debates about our knowledge of other people's mental lives. The result is a distinctive problem in the philosophy of mind concerning our relation to other people.

In the section ‘Unity and Objectivity’ of The Bounds of Sense, P. F. Strawson argues for the thesis that unity of consciousness requires experience of an objective world. My aim in this essay is to evaluate this claim. In the first and second parts of the essay, I explicate Strawson's thesis, reconstruct his argument, and identify the point at which the argument fails. Strawson's discussion nevertheless raises an important question: are there ways in which we must think of our experiences (...) if we are to self-ascribe them? In the third part of the essay, I use Kant's remarks concerning the passivity of experience to suggest one answer to this question: in self-ascribing experiences, we must be capable of thinking of them as passive to their objects. This can be used to provide an alternative route from unity to objectivity. (shrink)

‘How, then, she had asked herself, did one know one thing or another thing about people, sealed as they were?’ So asks Lily Briscoe in To the Lighthouse. It is this question, rather than any concern about pretence or deception, which forms the basis for the philosophical problem of other minds. Responses to this problem have tended to cluster around two solutions: either we know others’ minds through perception; or we know others’ minds through a form of inference. In the (...) first part of this paper I argue that this debate is best understood as concerning the question of whether our knowledge of others’ minds is based on perception or based on evidence. In the second part of the paper I suggest that our ordinary ways of thinking take our knowledge of others’ minds to be both non- evidential and non-perceptual. A satisfactory resolution to the philosophical problem of other minds thus requires us to take seriously the idea that we have a way of knowing about others’ minds which is both non-evidential and non-perceptual. I suggest that our knowledge of others’ minds which is based on their expressions – our expressive knowledge - may fit this bill. (shrink)

A commentary on articles by Klein, Pockett, and Trevena and Miller, in this issue, is given. Average shift in the point of subjective equality , calculated by Klein on Libet's data, and corresponding change in mean shift, calculated by Libet et al. , may be “corrected,” taking as a reference point the end of the minimum train duration. Values obtained, if significant, indicate a latency for conscious sensation of the skin stimulus of at least 230 ms. Pockett's main conclusions are (...) favored, but her explanation of peripheral–lemniscal couplings is found to be unconvincing. Trevena and Miller's article unsuccessfully tries to rescue a dualist interactionist view. Libet's method of timing intentions is thoroughly criticized. (shrink)

What is the status of the claims which make up Kant’s arguments in the Critique of Pure Reason? This question seemed to Kant’s contemporaries to require a metacritique. Strawson’s criticisms of Kant should be understood in this context: as raising a metacritical challenge about Kant’s grounds for the claims which make up his arguments. What about the claims which make up Strawson’s own arguments in The Bounds of Sense? I argue in this chapter, against what I take to be the (...) general consensus, that Strawson did not and should not have understood these claims to be analytic. Rather he is somewhat puzzlingly committed to our possessing non-analytic but still a priori knowledge of his claims. What could such knowledge consist in? I’ll extract from G.E. Moore’s early writings on Kant a model for understanding such knowledge, one which enables us to better appreciate the way in which Strawson’s methodology dovetails with Kant’s own. (shrink)

This paper is about a support information management system for a wind power producer having an energy storage system and participating in a day-ahead electricity market. Energy storage can play not only a leading role in mitigation of the effect of uncertainty faced by a WP producer, but also allow for conversion of wind energy into electric energy to be stored and then released at favourable hours. This storage provides capability for arbitrage, allowing an increase on profit of a WP (...) producer, but must be supported by a convenient problem formulation. The formulation proposed for the support information management system is based on an approach of stochasticity written as a mixed integer linear programming problem. WP and market prices are considered as stochastic processes represented by a set of scenarios. The charging/discharging of the ESS are considered dependent on scenarios of market prices and on scenarios of WP. The effectiveness of the proposed formulation is tested by comparison of case studies using data from the Iberian Electricity Market. The comparison is in favour of the proposed consideration of stochasticity. (shrink)

Early twentieth-century philosophers of perception presented their naïve realist views of perceptual experience in anti-Kantian terms. For they took naïve realism about perceptual experience to be incompatible with Kant’s claims about the way the understanding is necessarily involved in perceptual consciousness. This essay seeks to situate a naïve realist account of visual experience within a recognisably Kantian framework by arguing that a naïve realist account of visual experience is compatible with the claim that the understanding is necessarily involved in the (...) perceptual experience of those rational beings with discursive intellects. The resultant view is middle way between recent conceptualist and non-conceptualist interpretations of Kant, holding that the understanding is necessarily involved in the kind of perceptual consciousness that we, as rational beings, enjoy whilst allowing that the relations of apprehension which constitute perceptual consciousness are independent of acts of the understanding. An examination of conditionals in di¤erent languages leads to a distinction of three types of conditionals instead of the usual two (indicative and subjunctive). The three types can be explained by the degree of acceptance or as-if acceptance of the truth of the antecedent. The labels subjunctive and indicative are shown to be inadequate. So-called indicative conditionals comprise two classes, the very frequent uncertain-fact conditionals and the quite rare accepted-fact conditionals. Uncertain-fact conditionals may have a time shift in contemporary English (...) and the future subjunctive in Portuguese (though not all of them do). Moreover, paraphrases of if with in case or supposing are usually possible with approximately the same meaning. Accepted-fact conditionals never have these features. (shrink)

This paper investigates whether 'even if A, B' is pragmatically polysemic, so that a nonconcessive conditional may have 'even if', and whether concessive conditionals, pragmatically defined, can fail to have 'even if' or a non-temporal 'still'. Different paraphrases are used to help elucidate pragmatic meanings. A theory of the pragmatic meanings of concessive and implicative conditionals is presented. The semantic meaning of 'even if' and the question of whether concessive conditionals imply the truth of their consequents are also discussed.

Not all symmetries are on a par. For instance, within Newtonian mechanics, we seem to have a good grasp on the empirical significance of boosts, by applying it to subsystems. This is exemplified by the thought experiment known as Galileo’s ship: the inertial state of motion of a ship is immaterial to how events unfold in the cabin, but is registered in the values of relational quantities such as the distance and velocity of the ship relative to the shore. But (...) the significance of gauge symmetries seems less clear. For example, can gauge transformations in Yang-Mills theory—taken as mere descriptive redundancy—exhibit a similar relational empirical significance as the boosts of Galileo’s ship? This question has been debated in the last fifteen years in philosophy of physics. I will argue that the answer is ‘yes’, but only for a finite subset of gauge transformations, and under special conditions. Under those conditions, we can mathematically identify empirical significance with a failure of supervenience: the state of the Universe is not uniquely determined by the intrinsic state of its isolated subsystems. Empirical significance is therefore encoded in those relations between subsystems that stand apart from their intrinsic states. (shrink)

Their reply clarifies the nature of their objections to phenomenal particularism and helps identify the locus of our disagreements. In what follows we aim to defend phenomenal particularism against the objections raised in their reply.

In this article I compare Hume and Whitehead on the experience of causality. I examine Whitehead's examples of such an experience and I offer a defense of Whitehead against Hume on this topic.

The inherent difficulty in talking about quantum decoherence in the context of quantum cosmology is that decoherence requires subsystems, and cosmology is the study of the whole Universe. Consistent histories gave a possible answer to this conundrum, by phrasing decoherence as loss of interference between alternative histories of closed systems. When one can apply Boolean logic to a set of histories, it is deemed ‘consistent’. However, the vast majority of the sets of histories that are merely consistent are blatantly nonclassical (...) in other respects, and further constraints than just consistency need to be invoked. In this paper, I attempt to give an alternative answer to the issues faced by consistent histories, by exploring a timeless interpretation of quantum mechanics of closed systems. This is done solely in terms of path integrals in non-relativistic, timeless, configuration space. What prompts a fresh look at such foundational problems in this context is the advent of multiple gravitational models in which Lorentz symmetry is not fundamental, but only emergent. And what allows this approach to overcome previous barriers to a timeless, conditional probabilities interpretation of quantum mechanics is the new notion of records—made possible by an inherent asymmetry of configuration space. I outline and explore consequences of this approach for foundational issues of quantum mechanics, such as the natural emergence of the Born rule, conservation of probabilities, and the Sleeping Beauty paradox. Some comments on Quassim Cassam’s Self and World written for a conference at the Institute of Philosophy in 2017. I consider the objection that Cassam raises to Strawson’s argument from unity to objectivity in The Bounds of Sense and raise some general questions about Cassam’s problem of misconception and its application to transcendental arguments.

One of the abiding themes of the three essays which make up Iris Murdoch’s wonderful The Sovereignty of Good1 is that experience can be a way of our coming to possess aesthetic concepts. “We learn through attending to contexts, vocabulary develops through close attention to objects, and we can only understand others if we can to some extent share their [spatio-temporal and conceptual] contexts.” (IP, p.31). My interest in this paper is in what account of aesthetic experience can respect this (...) intuition; that “close attention to objects” can play an important role in our acquisition of aesthetic knowledge and concepts. I want to suggest that certain debates in the philosophy of mind can help us consider how aesthetic experience must be structured in order to play this role. (shrink)

Local gauge theories are in a complicated relationship with boundaries. Whereas fixing the gauge can often shave off unwanted redundancies, the coupling of different bounded regions requires the use of gauge-variant elements. Therefore, coupling is inimical to gauge-fixing, as usually understood. This resistance to gauge-fixing has led some to declare the coupling of subsystems to be the \textit{raison d'\^etre} of gauge \cite{RovelliGauge2013}. Indeed, while gauge-fixing is entirely unproblematic for a single region without boundary, it introduces arbitrary boundary conditions on the (...) gauge degrees of freedom themselves---these conditions lack a physical interpretation when they are not functionals of the original fields. Such arbitrary boundary choices creep into the calculation of charges through Noether's second theorem, muddling the assignment of physical charges to local gauge symmetries. The confusion brewn by gauge at boundaries is well-known, and must be contended with both conceptually and technically. It may seem natural to replace the arbitrary boundary choice with new degrees of freedom, for using such a device we resolve some of these confusions while leaving no gauge-dependence on the computation of Noether charges \cite{DonnellyFreidel}. But, concretely, such boundary degrees of freedom are rather arbitrary---they have no relation to the original field-content of the field theory. How should we conceive of them? Here I will explicate the problems mentioned above and illustrate a possible resolution: in a recent series of papers \cite{GomesRiello2016, GomesRiello2018, GomesHopfRiello} the notion of a connection-form was put forward and implemented in the field-space of gauge theories. Using this tool, a modified version of symplectic geometry---here called `horizontal'---is possible. Independently of boundary conditions, this formalism bestows to each region a physically salient, relational notion of charge: the horizontal Noether charge. Meanwhile, as required, the connection-form mediates an irenic composition of regions, one compatible with the attribution of horizontal Noether charges to each region. Thes aims of this paper are to highlight the boundary issues in the treatment of gauge, and to discuss how gauge theory may be conceptually clarified in light of a resolution to these issues. Conditional assertions are a peculiar language structure that manifests a specific cognitive operation. In order to express it, different languages have found different ways of using verb forms. Primary conditionals are here defined as those that presuppose the possibility of the falsity of both the antecedent and the consequent. In them, the truth of the antecedent appears as a sufficient condition for the truth of the consequent. The truth condition of primary conditionals is defined as the impossibility of the conjunction (...) of the truth of the antecedent with the falsity of the consequent. The demand for a connection between antecedent and consequent, expressed by Chrysippus as the incompatibility between the affirmation of the antecedent and the denial of the consequent, is thus satisfied. Counterfactuals are conditionals that speak of some aspect of reality through the imagination of an unreal situation. (shrink)

While agreeing with Fischborn’s (2018) contention that, according to one traditional definition of compatibilism, my position should be classified as that of a libertarian incompatibilist, I argue here for a different view of compatibilism. This view involves, on the one hand, local probabilistic causation of decisions (rather than universal strict determinism) and, on the other, free will conceived as involving decisions generated by a decision-making process carried out by the brain, which consciously contemplates different alternatives and could in principle have (...) been different from what it was, implying that the agent could in normal conditions have done otherwise in the same circumstances. After discussing different views of causation (including determinism) and of free will, I make a revision of some passages from my earlier work, quoted by Fischborn. I conclude that what is crucial in the question of (in)compatibilism is the (in)compatibility between freedom of decisions and natural causation of human actions. According to this looser and, I argue, more pertinent view of compatibilism, I maintain my previous classification of my position on the matter as compatibilist. (shrink)

P.F. Strawson (1919-2006) was one of the most significant philosophers of the twentieth-century. His career centred around Oxford – first as Tutor and Fellow at University College, then as Waynflete Professor of Metaphysical Philosophy at Magdalen College. His careful, thoughtful, and characteristically elegant written work was influential in moving Oxford philosophy from the anti-metaphysical leanings of A.J. Ayer and J.L. Austin to a renewed and rejuvenated era of traditional philosophy theorising, albeit domesticated in a distinctively Strawsonian fashion. His influence on (...) British philosophy persists through a generation of students who were brought up on his writings. (shrink)

In the essays which make up The Sovereignty of Good, Iris Murdoch gives us a picture of moral life in which ‘the metaphor of vision [is] almost irresistibly suggested’. This chapter aims to clarify the role played by the metaphor of vision in Murdoch’s philosophical thinking. I’ll examine two different things which might be meant by the term ‘moral vision’: vision of moral things or vision which is itself moral. The suggestion will be that whilst both capture something important about (...) Murdoch’s work, each may mislead about what is distinctive in her views. For Murdoch, I shall suggest, there is no distinctively moral vision. There is only vision: a loving gaze directed upon the reality of others. (shrink)

Can the experience of great art play a role in our coming to understand the ethical framework of another person? In this article I draw out three themes from Iris Murdoch’s ‘The Sovereignty of Good’ in order to show the role that communal attention to works of art can play in our ethical lives. I situate this role in the context of Murdoch’s wider philosophical views.

In the paper we obtain a new characterization of the BCK-algebras which are subdirect product of BCK-chains. We give an axiomatic algebraizable extension of the BCK-calculus, by means of a recursively enumerable set of axioms, such that its equivalent algebraic semantics is definitionally equivalent to the quasivariety of BCK-algebras generated by the BCK-chains. We propose the concept of "linearization of a system" and we give some examples.

Abordagem do protagonismo social, analisando sua relação com a informação, concluindo pela compreensão deste como objetivo do trabalho informacional, situando a mediação da informação como sua ação central. Parte da apresentação das origens conceituais em torno do protagonismo, buscando, à medida que debate as referências acerca do tema, demonstrar a relação do desenvolvimento do protagonismo social com o trabalho informacional, assim como sua posição de meta da atividade da mediação da informação, executada nas suas cinco dimensões e na condição de (...) elemento central desse trabalho. As assertivas apresentadas são resultado do estudo crítico da bibliografia da área da Ciência da Informação que aborda o protagonismo e a mediação da informação, assim como de estudos de filósofos e pensadores que abordam os aspectos sociais e políticos da comunicação e da formação de sujeitos socialmente ativos, permitindo a identificação das relações entre protagonismo e mediação da informação, como também que a mediação consciente favorece o primeiro, concluindo que o apoio ao seu desenvolvimento representa a principal responsabilidade social do trabalho com a informação. The present paper is about the author’s current research on children’s education in urban contexts. It departs from the rising offer of programmes for school children in out-of-school contexts (e.g. museums, libraries, science centres). It asks what makes these practices educational (and not just interesting, entertaining and/or audience building). Based on Biesta (2006a, 2010) theory of education, the author frames and analyses the educational characteristics of, and possibilities of articulating, in and out-of-school educational practices. This paper aims at understanding if (...) the occasional outing from primary school premises promotes interruptions in the humanist foundations of school. In order to analyse relations between different institutions and professionals (to be) engaged in educational activities and programmes, Nóvoa (2002, 2009) essays will be brought to the discussion, namely his conception of the ‘Public Space of Education’—as a space where culture, education, arts, sports and leisure are shared responsibilities, and where diverse institutions are networked aiming towards societal pluralism. I argue for the possibility of using cities’ public spaces as contexts with a worldly quality to complexify children’s education. Nevertheless, I draw attention to the unbearable educational lightness that these practices may carry if they do not go beyond the praise of chance; as well as to their unsustainable weight if they perpetually repeat school’s normal orders and add up rational discourses. After a brief introduction to issues that plague the realization of a theory of quantum gravity, I suggest that the main one concerns defining superpositions of causal structures. This leads me to a distinction between time and space, to a further degree than that present in the canonical approach to general relativity. With this distinction, one can make sense of superpositions as interference between alternative paths in the relational configuration space of the entire Universe. But the full use of relationalism (...) brings us to a timeless picture of Nature, as it does in the canonical approach. After a discussion of Parmenides and the Eleatics' rejection of time, I show that there is middle ground between their view of absolute timelessness and a view of physics taking place in timeless configuration space. In this middle ground, even though change does not fundamentally exist, the illusion of change can be recovered in a way not permitted by Parmenides. It is recovered through a particular density distribution over configuration space which gives rise to 'records'. Incidentally, this distribution seems to have the potential to dissolve further aspects of the measurement problem that can still be argued to haunt the application of decoherence to Many-Worlds quantum mechanics. I end with a discussion indicating that the conflict between the conclusions of this paper and our view of the continuity of the self may still intuitively bother us. Nonetheless, those conclusions should be no more challenging to our intuition than Derek Parfit's thought experiments on the subject. (shrink)

As duas passagens serão estudadas pela lexicografia, no estudo dos termos gregos empregados pelo filósofo em comparação com o sentido das traduções em português utilizadas. Este artigo analisa a questão da enunciação literária em alguns dos escritos teóricos de Rousseau, em particular a Carta a D’Alembert, Do contrato social e o Ensaio sobre a origem das línguas, além do prefácio da Nova Heloísa. Neles, atenta-se ao modo como a literatura está intimamente relacionada à problemática da voz e do ordenamento das enunciações e dos corpos no pensamento político do autor, configurando assim uma política / polícia da literatura, conforme a distinção feita por Jacques Rancière.

Sobre os atos de problematização em Michel Foucault1 Resumo: Através do escrutínio de duas noções centrais do pensamento de Michel Foucault – crítica e genealogia–, este texto elucida o conceito de problematização, dando ênfase a seu possível caráter performativo. On its acts of problematization: Scrutinizing two main notions of Michel Foucault’s thinking – Critique and Genealogy -, this paper elucidates the concept of problematization, with an emphasis in its hypothetical performative aspect. Firstly, we build a perspective on the task of a critical thinker to, in a second moment, elucidate the difference between a history of solutions and a genealogy of problems. The provocative question mark in title refers to two attitudes alluded by Foucault. Palavras Mágicas: solução instantânea para questões pedagógicas? Resumo: O objetivo desse artigo é analisar, com base no aporte teórico-epistemológico da hermenêutica objetiva, a presença, a razão e utilização das palavras mágicas no contexto escolar, especialmente nas relações estabelecidas entre os alunos e professores. Para tanto, o cartaz “Palavras Mágicas”, uma imagem captada em uma escola pública do ensino fundamental, no município de São Carlos – SP, em 2018, foi reconstruído empiricamente e interpretado por um grupo de pesquisadores brasileiros e um (...) estrangeiro. O significado histórico-cultural das palavras mágicas, bem como o questionamento acerca da pertinência da adoção de práticas “pedagógicas mágicas” na escola, foi contrastado com o sentido pedagógico da formação escolar. Os resultados da análise indicam que a pedagogia não pode ser praticada de forma mágica, mediante a instantaneidade e instrumentalização de suas ações, pois se assim o for, estaríamos decretando o fim da Pedagogia. Abstract: The aim of this article is to analyze, based on the theoretical-epistemological contribution of objective hermeneutics, the presence, reason and use of magic words in the school context, especially in the relationships established between students and teachers. To this end, the poster “Palavras Mágicas”, an image captured in a public elementary school in the municipality of São Carlos - SP, in 2018, was reconstructed empirically and interpreted by a group of Brazilian researchers and a foreigner. The historical-cultural meaning of magic words, as well as the questioning about the pertinence of adopting “magical pedagogical” practices in school, were contrasted with the pedagogical sense of school formation. The results of the analysis indicate that pedagogy cannot be practiced in a magical way, by means of the instantaneous and instrumentalization of its actions, because if it happened, we would be decreeing the end of Pedagogy. El significado histórico-cultural de las palabras mágicas, así como el cuestionamiento sobre la pertinencia de adoptar prácticas "mágicas pedagógicas" en la escuela, se contrasta con el sentido pedagógico de la formación escolar. Los resultados del análisis indican que la pedagogía no se puede practicar de manera mágica, por medio de la instantánea y la instrumentalización de sus acciones, porque de ser así, estaríamos decretando el fin de la pedagogía. Guiado pelas teorias da decolonialidade e da performatividade, este artigo pretende discutir as possibilidades de uma teoria do humano no Direito que seja expansiva, rompendo com as leituras cis-heteronormativas e brancas das teorias dominantes sobre Direito e Justiça. Para isso, realiza duas tarefas: primeiro, toma as teorias sobre sexo, gênero e raça como linguagens atribuídas a corpos para usar o corpo como categoria jurídica de análise e, com esse corpo, aprendendo com as travestilidades, compreender o humano como sempre sendo “em (...) processo de”, exigindo-nos compromisso com “dignidades” produzidas a partir da multiplicidade da “pessoa”. Depois, usa duas categorias jurídico-constitucionais para rediscutir a entrada do “humano” no Direito nos marcos do gênero e da raça – e das múltiplas corporalidades: dignidade da pessoa humana e povo. Sem pretender resolver a oposição universalismo/individualismo contida nessas categorias, o trabalho sustenta a fronteira como lugar de expansão: um povo que performa pluriversalidades e a pessoa humana em suas multiplicidades. Essa teoria expansiva exige reconhecer que o humano é humano “em processo de” e coloca o limite dos sentidos produzidos pela tensão entre as duas categorias jurídicas no corpo, lido sob as linguagens de sexo, gênero e raça. Isso exigirá o compromisso e a responsabilização pela diminuição da distribuição diferencial de humanidade produzida na matriz branca e cis-heterconforme e o reconhecimento de que o sujeito que dá a si mesmo a “lei” deve poder se fazer mutuamente povo e pessoa humana.
